Disclosing criminal history is violation of privacy

 

o The National Human Rights Commission of Korea(Chairperson Lee Sung-ho) advised Chief of the National Police Agency to identify methods that police officials use to monitor people liable to committing crimes and devise a manual to prevent human rights infringement during the monitoring.

 

o The complainant filed a complaint to NHRCK saying that police officers told the fact he was imprisoned to his neighbors which is violation of privacy of the complainant and his spouse.

 

o Violation Rectification Committee 1 of NHRCK concluded that the police officer violated article 6.2 of the Rule on Collection of Intelligence on People Liable to Committing Crimes which prescribes that human rights of people liable to committing crimes should be respected to maximum extent and special attention has to be paid to not hard reputation or credibility of the person concerned, thereby infringing upon article 17 of the Constitution.

 

o NHRCK concluded that it is needed to identify and enhance the way police manage and monitor people liable to committing crimes because of the following reasons: it repeatedly received complaints regarding disclosure of private information during the process of collecting information about people liable to committing crimes; while the duty to report under the Rule on Collection of Intelligence on People Liable to Committing Crimes is excessively specific, rules on protection of human rights is superficial; and human rights violations are highly likely to occur given the nature of the work of monitoring people liable to committing crimes.
