NHRCK recommends to the chief of the National Policy Agency to provide procedures of fair notification in advance during holding the investigations.

The National Human Rights Commission(Chairpeson Hyun, Byung-chul) recommended to the chief of the National Policy Agency to provide procedures in which notify in advance to prisoners in detention facilities, that the fact of being suspected and schedule for the investigation when conducting the investigation related to suspected case besides the suspected case that caused he or she to be taken into the custody.

 

Complaint (male, 44) has filed a complaint to the Commission on September 2012 on the grounds that His right of defence has been infringed by conducting the several investigations without notifying the fact of being suspected and schedule for the investigation in advance during examining the suspect with cases which was not relevant to the case why he was held in the custody by police officers from July to August 2012 time of being housed in jail.

 

NHRCK made a judgement that the behaviors that the investigated and interviewed the petitioner imprisoned in a detention facility without any other notice violated rights to equality according to the Article 11, 12 of the Constitution.
