The National Human Rights Commission of Korea (NHRCK) expresses deep regret over a decision from the Ministry of Justice to forcefully deport three migrant workers on the morning of December 13, 2007 without prior notice. The deportation occurred during a NHRCK investigation, which was filed on November 27, 2007 by the Vice-Chairperson of the Korean Confederation of Trade Unions, Bong-Hee Ju, and Education and Propaganda Deputy Director of the Migrant Trade Union, Jeong-Won Lee.
The complaint submitted by Ju and Lee stated that the Seoul Immigration Office had railroaded Migrant Trade Union Chairperson Kajiman (Nepalese), Chairperson Lajubu (Nepalese) and Secretary-General Masum (Bangladeshi).
The Commission found through the obstructed investigation that the Migrant Trade Union’s executive staff, including the chairpersons, had been arrested at different places at the same time, according to statements submitted by the two complainants. These events occurred at a time when the Supreme Court had been deliberating the establishment of the Migrant Trade Union in response to an appeal made by the Ministry of Labor concerning a previous dismissal of a report on the establishment of the Migrant Trade Union.
The Commission was investigating the case, specifically in concern with allegations of railroading by the authorities involved. On December 3, 2007, the Commission requested that the Ministry of Justice and Seoul Immigration Office submit a written reply to the complaint. There was no response.
The Commission expresses strong regret over the Ministry of Justice’s decision to obstruct an on-going investigation and deport the three individuals involved with the Migrant Trade Union.
