Statement by the Chairperson of the National Human Rights Commission of Korea on the Declaration of Martial Law (December 3)


 The National Human Rights Commission of Korea views the current situation regarding the declaration of martial law on December 3 with grave concern.


 On the night of December 3, martial law and its accompanying proclamations were declared. However, thanks to the swift resolution by the National Assembly demanding its termination, the mature civic consciousness of the public, and the prudent efforts of military personnel on the ground, the martial law was lifted. This process reaffirmed that democracy is firmly established within our society, both before and after the martial law was rescinded and during efforts to address the situation.  


 All state power is entrusted by the people and must be exercised fairly and justly in a manner that adheres to the Constitution and the law and that is acceptable to the people.  


 Article 77 of our Constitution stipulates that the President may declare martial law "in the event of war, armed conflict, or a national emergency equivalent thereto, when necessary for military purposes or to maintain public peace and order, in accordance with the provisions of the law." Any violation of this provision can result in human rights infringements.  


 Moving forward, it is crucial to ensure rapid social stability and national unity. To this end, a thorough and transparent investigation must be conducted into any human rights violations that may have occurred during all phases before and after the declaration of martial law, following constitutional and legal procedures. All national agencies must also remain vigilant in their duties to protect the human rights of the people.  


 The National Human Rights Commission of Korea is committed to working towards the swift resolution of issues related to martial law and will continue to monitor the human rights situation closely, fulfilling its role in protecting the rights of the people.
