Ministry Accepts NHRCK Recommendation to Expand Reasonable Accommodations in Recruitment Examinations
NHRCK Recommended Amendment to Include All Entities Subject to Mandatory Disability Employment Quotas
On November 15, 2024, the National Human Rights Commission of Korea (NHRCK, Chairperson Ahn Chang-ho) recommended that the Minister of Health and Welfare amend Article 28 of the Enforcement Decree of the Act on Welfare of Persons with Disabilities to include all business entities subject to mandatory disability employment under Article 28-2 of the Act on the Employment Promotion and Vocational Rehabilitation of Persons with Disabilities as organizations required to provide reasonable accommodations to applicants with disabilities.
Ministry Accepts Recommendation
On July 10, 2025, the Ministry of Health and Welfare responded that it plans to amend Article 28 of the Enforcement Decree in the second half of 2025 to add local public corporations and authorities under the Local Public Enterprises Act, as well as organizations invested in or funded by local governments under the Act on the Operation of Local Government-Invested and Funded Organizations, all of which are subject to mandatory disability employment quotas, to the list of organizations required to provide accommodations to applicants with disabilities.
NHRCK Determines Ministry Has Accepted Recommendation
On October 1, 2025, the NHRCK's Committee on Discrimination Against Persons with Disabilities (Subcommittee Chairperson: Standing Commissioner Lee Sook-jin) determined that the Minister of Health and Welfare has accepted the Commission's recommendation.
Significance of the Amendment:
The current Article 28 of the Enforcement Decree designates organizations such as public institutions under the Act on the Operation of Public Institutions as entities required to provide reasonable accommodations to applicants with disabilities during recruitment examinations pursuant to Article 46-2 of the Act on Welfare of Persons with Disabilities.
The amendment will expand this scope to include local public corporations, local authorities, and local government-invested and funded organizations, all of which are already subject to mandatory disability employment quotas. This is significant in that applicants with disabilities will be able to receive reasonable accommodations tailored to their disability characteristics during recruitment examinations at local public corporations and similar entities.
Public Announcement
The NHRCK welcomes the Ministry of Health and Welfare's implementation of this recommendation and, recognizing that public disclosure serves the informational needs of affected stakeholders, announces this decision pursuant to Article 50 of the National Human Rights Commission of Korea Act.
Ongoing Commitment
The NHRCK will continue to work toward reforming discriminatory systems to ensure that applicants with disabilities receive reasonable accommodations during recruitment processes, and will maintain cooperation with relevant government ministries to ensure the effectiveness of its recommendations.
