NHRCK holds a conference discussing the application of international human rights standard in constitutional review

- The venue to discuss ways of utilizing international human rights norms in constitutional review to ensure rights of all people -

 

The National Human Rights Commission of Korea(Chairperson Doohwan Song, hereinafter the ‘NHRCK’ or the ‘Commission’) held a conference discussing the application of international human rights standard in constitutional review(hereinafter the ‘Conference’) on 23 August 2022 at the Constitutional Research Institute. The Conference was co-hosted by the Constitutional Research Institute of Korea, the Korean Constitutional Law Association and the Korean Public Law Association.

 

The NHRCK has been co-hosting conferences with the Court of Korea, the National Assembly and other institutions to enhance the role of the judiciary and legislative bodies on domestically implementing international human rights norms. The Conference was held to find ways to effectively apply and utilize international human rights standards, putting the focal point on applying the norms and standards on ‘constitutional review’ .

 

The Conference began with the opening remarks from Chairperson Doohwan Song of the NHRCK and the congratulatory remarks from President Heonhwan Lee of the Constitutional Research Institute of Korea, President Geonbo Kwon of the Korean the Constitutional Law Association and President Soyoung Cho of Korean Public Law Association.

 

The first session was on ‘raising awareness on international human rights norms and the application of the norms in constitutional review’. Professor Sanghee Han of Konkuk University Law School was the mediator for the session. Professor Jungin Cho of Seowon University School of Police explained the status of international human rights norms implemented in domestic laws and their features and advised on taking sociology-of-law approach in applying international human rights norms during constitutional reviews. The discussion followed after the presentation.

 

The theme of the second session was ‘utilizing international human rights norms in constitutional review’. The mediator for the session was Professor Jibong Lim of Seogang University Law School and Professor Jonghyun Park of Kookmin University School of Law gave presentation relevant to the topic. In his presentation, Professor Park analyzed the decisions made in constitutional reviews using international human rights norms and advised on ways to systematically apply the international standards in domestic settings. The discussion followed after the presentation.

 

The National Human Rights Commission of Korea, together with the stakeholders, will continue to discuss the matter of applying international human rights standards in constitutional reviews, so as to effectively apply and implement international human rights norms in Korea.
