Operation of Control Center of Surveillance Camera without legal basis is infringements of human rights

o National Human Rights Commission of Korea recommended to the Minister of the Interior and Safety to devise a legal ground on standard and procedure for usage and provision of video footage to protect the right to self-determination in operation of the CCTV Control Centers.

o At CCTV Control Centers established and operated by local governing bodies, CCTVs installed at local public institutions are linked and every footage is available. According to the Ministry of the Interior and Safety, among 226 local governing bodies, 190 (84%) bodies established CCTV Control Centers. Centers, with cooperation with public officials of local governing institutions and police officers, respond to emergencies and control and maintenance of the footage are commissioned to private institutions.  

o The Constitution of the Republic of Korea prescribes that any measure that might limit people’s basic rights has to have legal ground. In addition, the Personal Information Protection Act prohibits using personal information for purposes other than the original purpose or providing the information to third parties. The Acts allows exceptions only when there exists a special provision under other acts.

 

o However, the CCTV Control Centers which collect, save, and use surveillance footages, do not have legal ground for establishment and operation under the Personal Information Protection Act or other Acts despite possibility of infringement of personal information. In addition, in many cases, footages are used for purposes different from the original one, and provided to police. Moreover, there are often police officers who stay at the center and monitors footages.

 

o The Act on Protection of Personal Video Information, etc. proposed by the Ministry of the Interior and Safety to the National Assembly in December last year includes some provisions related to the CCTV Control Center. However, NHRCK concluded its not sufficient to address infringements issue.

 

o Accordingly, NHRCK advised to the Minister of the Interior and Safety to provide legal ground for establishment and operation of CCTV Control Centers in compliance with the Constitution and to incorporate into the law measures to protect personal video information including detailed procedure and requirement for usage and provision of video footage to third parties.
