Junju Christian Institute rejected accepting recommendation of NHRCK

National Human Rights Commission of Korea recommended to Chief Director of Junju Christian Institute to give warning to the head of Kijeaon University and to devise measures to prevent violation of freedom of occupation and the institute expressed its decision not to accept recommendation.

 

Junju Kijeon University had to re-appoint Professor A. pursuant to the ruling of the Supreme Court, but it placed him on the waiting list for closing the department until creation of a new department. During that period, the university removed him from the finger-print recognition system to prevent him entering the Research Center for Professors, and blocked his access to a computer net. Complainant filed a complaint that such measures of the school is human rights violation.

 

Violation Rectification Committee 2 of NHRCK concluded that the school violated freedom of vocation prescribed under the Constitution given that the school rule states that a teacher who is in the process of lawsuit against the school for reinstatement after dismissal should continue carry out research and that Professor A needs to communicate with other teachers and to gather information to have an idea about creating a new department after reinstatement.

 

However, the school argued that the rule is to encourage teachers in lawsuit to continue carry out their research, and it does not necessarily mean the school needs to allow access to lab or computer network. The school stated that it cannot accept NHRCK’s recommendation since the school did not violate freedom of vocation of the complainant.
