Convention on the Rights of Persons with Disabilities Takes Effect in Korea

On January 10, 2009, the U.N. Convention on the Rights of Persons with Disabilities (“the Convention”) came into effect in Korea.  The National Human Rights Commission of Korea (“NHRCK”) wholeheartedly welcomes the occasion as it means that Korea has now joined the international community’s commitment to securing the rights of those with disabilities.  The NHRCK believes that this represents a turning point in the promotion and protection of rights of the disabled in Korea and hopes that relevant laws and systems be established to fulfill the standards set forth in the Convention. 

 

The NHRCK first recommended that the Korean government ratify the Convention in its entirety on September 17, 2007. Unfortunately, however, the government has chosen to exercise a reservation with regard to Article 25 provisions relating to issues of insurance.

 

The Convention’s taking effect will serve as a catalyst for promoting the rights of persons with disabilities and the NHRCK will work towards the fulfillment of the standards set forth in the Convention. In this regard, the NHRCK hopes that the Korean government repeal its current reservation on Article 25 and join the Committee of State Parties set forth in the Optional Protocol to the Convention in the near future.
