o National Human Rights Commission of Korea recommended to the head of ○○ Regional Prosecutors Office to provide education for staff to ensure that during the process of reading and copying case records, personal information of third party is not revealed.
o The complaint found out that one of his acquaintance has a copy of case record where his criminal charges, previous criminal records, resident registration number and picture is included. He filed a complaint to NHRCK for leakage of private information.
o The prosecutor’s office involved responded that they are making their best effort to prevent leakage of personal information by reviewing every evidence record but still it is hart do completely prevent such leakage with a huge number of reading and copying request.
o NHRCK found out that the document held by complainant’s acquaintance, picture, resident registration number, imprisonment record and address of another person was also included.
o Violation Remedy Committee 1 of NHRCK concluded that leakage of such information during the copying process of case record is in violation of the principle of protection of personal information guaranteed under the Act on Protection of Personal Information and also violated article 17 of the Constitution. Accordingly, NHRCK recommended to the ○○ Regional Prosecutors Office to prevent recurrence by carrying out eduction for its employees.
