Ministry of Health and Welfare Accedes to NHRC Recommendation on National Pension Act Amendment

Payment obligations may be temporarily suspended for persons confined in prisons and protective institutions, as well as persons who have been missing for less than one year


 

On 14 August 2003, the National Human Rights Commission (NHRC) had delivered a written opinion to the Minister of Health and Welfare (MOHW) relating to National Pension Act (NPA) draft amendment (refer to press release for 18 August 2003). On 3 November 2003, the MOHW notified the Commission that it had submitted, to the Korean National Assembly, a revised draft amendment with changes reflecting acceptance of the NHRC recommendation.


 

Acceding to the NHRC recommendation, MOHW has notified the NHRC that it would: (1) consistent with the current system, temporarily suspend payment (into the pension system) obligations on the part of persons confined in correctional or protective facilities, (2) exclude from the pension system persons who have been missing for over one year, and temporarily suspend payment obligations on the part of those missing for under one year, and (3) change the wording from “those confined in correctional institutions” to “those who are confined in prisons, as in the current article 2, and other confinement facilities” for persons who may temporarily suspend regular payments into the system.
