NHRC Issues Recommendation to Minister of Labor to Amend Enforcement Decree of National Technical Examination Act

Technical Exam Prerequisites Discriminating on the Basis of Educational Background Violates the Right of Equality”


 

The National Human Rights Commission (NHRC) has found that the Enforcement Decree of the National Technical Examination Act discriminates against graduates of 2-year technical colleges and has issued a recommendation to the Minister of Labor to amend the Enforcement Decree. The Commission ruling follows complaints filed between April and June 2003 by Kim and 2 others charging that table 4 of the Enforcement Decree violates equality rights of persons graduating from 2-year colleges because it requires such graduates to have work experience as an exam prerequisite, even if their degree specialized in the area of the technical exam, whereas graduates of 4-year universities can elect to take the technical exam, regardless of whether they have work experience or even a related major.
