Seoul City announced its non-acceptance of the Commission's recommendation, claiming that selection of candidates for liquidation was based on due process and objective criteria. In response to this, the Commission chose to publicize Seoul City’s non-acceptance in accordance with the Article 4 Paragraph 4 and Article 44 Paragraph 2 of the National Human Rights Commission Act.
The Commission recognizes the purpose of organizing candidates for liquidation and understands the system itself. Even though the purpose of the system is reasonable, it should be in line with due process and objective criteria. Even though the majority of the selection processes and education programs in 2008 have been improved compared to those in 2007, the Commission recommended that Seoul City take appropriate measures to prevent recurrence of human rights violations. However, Seoul City argued the Commission did not fully understand concerned regulations and decisions which are stipulated in the Act on the Education and Training of Public Officials and denied the Commission’s decisions and recommendations. Seoul City, as a public organization, has an obligation to protect human rights, accordingly the Commission inevitably chose to publicly announce Seoul City’s non-acceptance of the Commission’s recommendation.
