Urgent Inquiry into Massive Crackdown on Undocumented Migrant Workers

On November 14, the Commission launched a fact-finding investigation on filed petition which claimed that in the process of massive crackdown, many of the arrested migrants were injured and some of them needed surgery. Complaints also alleged that they broke down migrant workers' houses with physical force. The Ministry of Justice, in cooperation with the Immigration Bureau, prosecutors and the police, conducted a massive crackdown on undocumented migrants and arrested 100 undocumented migrants in Maseok Furniture Industrial Complex (Namyangju City in Gyeonggi Province) and on Cheongsan Farm (Gyeonggi Province) on November 12, 2008.
In regards to the forcible crackdown, in 2005, the Commission recommended that related organizations amend the Immigration Control Law to establish practical control system with due process concerning countermeasures which severely restrict physical freedom and that these organizations take disciplinary measures against officers who use physical violence and harsh treatment and express negligence forward the injured migrants in the process of crackdowns. In July 2008, the Commission visited two houses of migrants including the Hwaseong Immigration Processing Center and two Immigration Bureau Offices and interviewed protected migrants. The Commission will report the result of these visits and the resultant investigation in December, 2008.
This fact-finding investigation will focus on whether the violence was used in the crackdown process, whether officers used excessive tools, and whether migrant children were included in the crackdown. The Commission will also focus on the effects of the combined crackdown measures.
Apart from the Commission’s fact-finding investigation, Commissioners from the National Human Rights Commission of Nepal and the Philippines also visited the place where the crackdown took place on November 14. The Commission, throughout this investigation, will investigate the human rights violation against undocumented migrants in the process of crackdown.
