The Commission, on August 25, recommended that High School A in Incheon establish adequate standards for self-study rooms which were classified by students’ academic performance in order to provide equitable education opportunities and a qualified education environment. In response to this, the school, on September 29, accepted the Commission's recommendation and announced the establishment of '2008 Study Room Management Plan.’
Mr. SHIN (male, 46 years old) filed a complaint in March 2008 against, inter alios, the principal of a high school in Incheon, claiming that the high school allowed only 30 students who displayed excellent academic performance in each grade to use the self-study room, thereby discriminating against those who could not use the self-study room.’
Article 31, Paragraph 1 of the Constitution stipulates that ‘all citizens shall have an equal right to receive an education corresponding to their abilities.’ Thus, the Commission confirmed that the school violated the right to equality.
The Commission welcomes High School A’s decision to change its management system of the self-study room. Hopefully, this change will be a positive influence on other schools and ensure widespread student equality in the opportunity to obtain an education.
