No Discrimination Against Foreigners in Online Identification System

The Commission recommended that the representatives of four ‘Online Real Name Identification Service Providing Organizations’ (the Korea Association of Information & Telecommunication and the National Information & Credit Evaluation, Inc., Seoul Credit Rating & Information Inc., and Korea Information Service Inc.) establish systems to provide identification services for foreigners and that the Korea Communications Commission (KCC) develop identity verification systems which do not discriminate against foreigners.


The Commission filed a petition which claimed that in the process of identification to use internet web sites, foreigners were not able to use the name-based identification system. Thus, the Commission launched an inquiry on March 24, 2008 regarding discrimination against foreigners from ‘Online Real Name Identification Service Providing Organizations.’

The current ‘Act on Promotion of Utilization of Information System’ states that among web sites of government bodies and information communication service providers with more than 100,000 views per day, those who have qualifications prescribed by the Presidential Decree are required to have a real name identification system.

Upon the Commission’s investigation, however, only foreigners who reside in Korea for more than 90 days are provided foreign registration number, but if they do not possess these numbers, they are not able to confirm their identity on web sites. In addition, separate identity verification services through certificate of foreign registration or passport have not been provided, while Korean citizens are provided the service through certificate of resident registration even though they are not registered in the database of the ‘Online Real Name Identification Service Providing Organization.’  Furthermore, numerous Web sites are identifying their online users only through resident registration number and name. Thus, real name-based identification services are not provided to foreigners.

Hence, the Commission recommended that the ‘Online Real Name Identification Service Providing Organizations’: provide additional identity verification services based on identity document; provide identity verification service to those who does not have a foreign registration number; establish a self-identifying system that does not differentiate between resident registration numbers and foreign registration numbers; and notice this on their web sites. The Commission also recommended that the Korea Communications Commission develop secure and reliable identification systems which do not discriminate against foreigners.
